Terms & Privacy Policy
Part 1: Terms and Conditions
1. About these terms
These Terms and Conditions apply to your use of this website and to estimates and services we provide. Tucasa Home Improvement (“Tucasa”, “we”, “us”) is a handyman and home renovation business in Whitchurch-Stouffville, Ontario. By using this website or asking for an estimate you agree to these terms and to our Privacy Policy (part 2 of this page). If you do not agree, please do not use the website.
When we do work for you, the written estimate, quote or contract for that job also applies. If it says something different from these terms about your job, the written quote or contract comes first.
2. Our services
We offer handyman and installation work, interior finishing, renovations, and fixtures and connections, as described on the website. Electrical work and plumbing connections are carried out by licensed, insured tradespeople who work with us. We do not do work outside our service list. This includes roofing; driveways, paving, concrete and stone work; foundation and structural work; window installation, outdoor window caulking and window screens; lawn work, gardening, sheds and tree cutting; gas work and gas pipes; furnaces and heating or cooling systems; hot water tanks, including tankless; pools; snow removal; garage doors; pest control; and removal of asbestos or mould. We may also decline any other work that Tucasa or its staff decide we cannot deliver.
The website describes what we do in general. Service descriptions, prices mentioned in promotions, photos and examples are not an offer or a guarantee of a specific result. Our service area is shown on the website, and we may decline work outside it.
3. Free estimates, estimate fees and quotes
Our free estimate policy. Estimates are free when we provide them online, by email or by phone, and in some cases for home visits, with our approval before the visit. We will never charge you for an estimate unless we have told you about the fee first and you have agreed to it.
When an estimate fee applies. We may charge a fee of at least $150 CAD plus HST for an estimate that needs long travel and measuring, an inspection to find the cause of a problem, or any other service that does not qualify as a free estimate because of the time and cost it takes the tradesperson.
- We will tell you the fee before we book the visit.
- If you agree, a booking deposit of at least $50 is required to confirm the booking. The remainder of the fee is due when the estimate or inspection is finished.
- The booking deposit is non-refundable once the visit is booked, because it covers the time and travel we set aside for you.
- The fee is credited to your job. If you approve the work with us within 30 days of the paid estimate, everything you paid for the estimate is credited back to you as a payment toward the total cost of the job, and is shown on your quote or invoice.
Written quotes. After an estimate we may give you a written quote, prepared from the details and photos you give us and, where needed, a home visit.
- A written quote is valid for 30 days from the date on it, unless it states otherwise. Material prices and availability can change after that.
- The price in a quote assumes the job is as described. If we find something different once work begins (for example hidden damage or a change you ask for), we will explain it and agree any change in price with you before we continue.
- Prices are in Canadian dollars. Ontario HST (13 percent) is added to invoiced work unless the quote says it is included.
4. Contracts for larger jobs
For larger projects we provide a written contract that sets out the work, price, payment schedule, timeline and any warranty. Work starts once you have agreed in writing. Nothing in these terms limits any rights you have under Ontario’s Consumer Protection Act, 2002 or other consumer law, including any right to cancel certain agreements within the time the law allows.
5. Scheduling, access and cancellation
- Please give us safe, clear access to the work area at the agreed time and tell us about pets, alarms, parking limits or anything else that affects the job.
- Please give us at least 48 hours notice to cancel or reschedule a booked visit or job. With less notice, we may keep any deposit or charge for materials already ordered and time already set aside for you. The estimate booking deposit is covered separately in section 3.
- Dates are our best estimate. Weather, material delays, illness, other trades and issues found on site can move them. We will tell you promptly if a date changes.
6. Payments
- Minimum service charge. Our minimum charge is $150 CAD plus HST, which covers up to one hour of work. Time beyond that is billed hourly, or we agree a set price with you for the whole job before we continue. This is separate from the estimate fee in section 3, which applies only to paid estimate visits.
- Any deposit is set in your signed contract. We accept the payment methods we list on the website or in your quote, currently cash, Interac e-transfer and credit card. A surcharge of up to 4 percent applies to credit card payments to cover the cost of the card terminal. We will tell you about it before you pay, and it does not apply to cash or e-transfer.
- Invoices are due as stated on the invoice or contract. If payment is late, we may pause further work and charge any late-payment interest that your contract states.
- Materials you ask us to order specially may be non-refundable once ordered.
7. Permits, inspections and licensed work
Some work needs a permit or an inspection (for example electrical work). Unless your contract says otherwise, we will tell you what is needed and arrange it with you. Work that the law requires a licensed tradesperson to do is carried out only by one. For privacy and security, licence and insurance details are not published on this website; they are provided to you privately with your confirmed quote.
8. Warranty and service guarantee
Different work items receive different warranties, and not all of our services come with a warranty. If a warranty applies to your job, we provide a service quality warranty on our work for a defined term. The details and the term are explicitly stated in the quote we give you, before the job starts. A customer may waive the warranty. In that case, no warranty applies to that work.
If a defect in our workmanship appears during the warranty term stated in your quote, tell us and we will inspect it and repair it at no charge, within a reasonable time.
We do not provide a warranty on repairs to old appliances, equipment or accessories, or on any item that is made by another company and carries its own warranty policy. Please follow up with the manufacturer for those warranties.
A warranty does not cover: normal wear and tear; damage from misuse, accidents, water, pests or movement of the building; work altered or repaired by someone else; products or materials you supplied; or problems caused by conditions we told you about before starting.
To make a claim, contact us with your name, the job address and date, a description of the problem and photos. We keep customer and job records for this purpose (see our Privacy Policy).
9. Your responsibilities
- Give us accurate information and tell us of any known hazards, such as asbestos, mould, knob-and-tube wiring or structural damage.
- Be sure you own the property or have the owner’s permission for the work.
- Remove or protect valuables and fragile items from the work area. We take care, but you are responsible for items you leave in the way.
10. Insurance and liability
We carry liability insurance for our work. To the fullest extent the law allows, we are not responsible for indirect or consequential loss (such as lost income or the cost of alternative accommodation), or for loss caused by things outside our reasonable control. Our total liability for a job is limited to the amount you paid us for that job, except where the law does not allow us to limit liability, including for death or personal injury caused by negligence or for fraud.
Nothing in these terms excludes or limits any warranty or right that the law gives you and that cannot be excluded.
11. Using this website
- Use the website lawfully. Do not try to break, overload or gain unauthorized access to it, send harmful code, or submit false or someone else’s information.
- The website content, including text, photos, illustrations, the logo and design, belongs to Tucasa or its licensors and may not be copied or reused without our written permission.
- Photos you send us stay yours. You allow us to use them to prepare your estimate and carry out and support your job, and to share them with the tradespeople assigned to it.
- The website is provided “as is”. We try to keep it accurate and available but do not promise that it will be error-free or always online. Links to other websites are for convenience, and we are not responsible for their content.
12. Reviews and testimonials
Reviews and testimonials on this website come from real customers. Reviewer names may be shortened for privacy, and examples shown beside a review that has no customer photo are illustrations and are labelled as such.
13. Events outside our control
We are not in breach of these terms or a contract if we are delayed or prevented by events outside our reasonable control, such as severe weather, supplier shortages, illness, strikes, fire, flood or government action. We will tell you and agree a new plan.
14. Governing law and disputes
These terms and any dispute about them are governed by the laws of Ontario and the federal laws of Canada that apply there, and you agree to the courts of Ontario. Before starting a claim, please contact us so we can try to resolve the problem together.
15. Changes and general terms
We may update these terms from time to time. The updated version applies from the date shown at the top of this page, and does not change a written quote or contract already agreed. If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, we have not given it up.
16. Contact us
Tucasa Home Improvement, Whitchurch-Stouffville, Ontario. We have no storefront and work from a private workshop in Stouffville; we come to you. For questions about these terms, email us.
Part 2: Privacy Policy
1. Who we are and what this policy covers
Tucasa Home Improvement (“Tucasa”, “we”, “us”) is a handyman and home renovation business based in Whitchurch-Stouffville, Ontario, owned and run by Ethan Dun. This policy explains what personal information we collect through this website and while we provide estimates and services, how we use and protect it, and the choices you have.
We follow Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and Ontario law. Ethan Dun is responsible for privacy at Tucasa. To reach him, email us (see section 13).
2. Information we collect
We collect only what we need to give you an estimate and carry out the work. This includes:
- Your request: name, email address, phone number, postal code, street address (optional), the service you need, your project description and your preferred way to be contacted.
- Photos and files you send us of your home or project, and any measurements or notes you give us.
- Job records: site details, measurements, notes, quotes, contracts, invoices, payment confirmations, scheduling details, photos taken during or after the work, and messages between you and us. We do not store full payment card numbers on this website.
- Your consent: a record that you agreed to be contacted and to have your details shared with our tradespeople for your estimate.
- Basic technical data: like most websites, our hosting provider may log your IP address, browser type and the pages requested, for security and to keep the site running.
If you ask the website to find your town, your browser asks your permission first. Your location is compared with our service-area list inside your own browser. It is not sent to us or stored.
3. How we use your information
We use your information to:
- reply to your request and contact you by email or phone;
- prepare estimates and quotes, and arrange a home visit when we need to measure or see the job;
- schedule and carry out the work, including by the handymen and licensed tradespeople who work with us;
- prepare contracts and invoices, take payment and keep our financial records;
- support warranty claims and our service guarantees (see section 6);
- protect the website and our business, prevent fraud and meet our legal obligations;
- improve our services and this website, using information that does not identify you where possible;
- send you Tucasa Home Improvement marketing, such as promotional offers and newsletters, by email (see section 4).
We do not sell your personal information, and we do not use it for advertising by other companies.
4. Your consent and our communications
When you send a request, you tick a box to confirm that you authorize Tucasa to contact you by email or phone and to provide the estimate services you asked for, that your details may be shared with our handymen and tradespeople for that purpose, and that you agree to receive calls or emails from Tucasa and its tradespeople about your request. This is your express consent under Canada’s anti-spam law (CASL) and privacy law.
We use these messages for your request and for the work we do for you. You can withdraw your consent or unsubscribe at any time: email us. We will stop contacting you about anything other than work already under way or required by law.
Marketing emails. The email address you share with us may be used to send you Tucasa Home Improvement marketing: promotional offers, seasonal specials and newsletters. We send these only where Canada’s anti-spam law allows, for example when you have agreed to receive them or because you are an existing customer. Every marketing email includes an unsubscribe link, and you can also ask to be removed at any time: email us. We will take your address off the marketing list within 10 business days. Unsubscribing does not affect messages about an estimate or job that is under way.
5. Who we share your information with
We share information only as needed, and only for the purpose you gave it to us:
- Our handymen and tradespersons: the people who visit your home to measure or quote, and who carry out your work (for example a licensed electrician or plumber), receive the details they need for that job and no more.
- Service providers that help us run the business: website hosting (Netlify), our database and private file storage (Supabase, with data held in Canada), email delivery (Resend), and Google services such as email, search listings and maps. They may only use your information to provide their service to us. Some of them may handle data outside Canada, where different privacy laws can apply.
- Professional advisers, insurers, regulators and authorities when we need their advice or the law requires us to disclose information.
- A buyer of the business, if Tucasa is ever sold, who would have to honour this policy.
6. How long we keep your information
We store customer information and job details so that we can honour warranty claims and our service guarantees. This includes your contact details, your project description and photos, quotes, contracts, invoices and notes about the work. We keep them for as long as a warranty or guarantee on the work may apply, and as long as the law requires us to keep business, tax and insurance records. We do not set a fixed deletion date while a warranty or guarantee may still be relied on.
You can ask us to delete your personal information at any time. Send us a clear request (email us) and we will delete it, and tell our service providers to delete it too, except for records we are legally required to keep (such as invoices for tax purposes), which we will keep only for that purpose and tell you about. Please note that once your information is deleted, we may no longer be able to verify a warranty claim or provide service guarantees for that job.
Private photos and files you send us are kept in private storage. They are not published.
7. Photos of our work
We may take photos of finished work for our records and to show future customers. We do not publish photos of your home without your permission. When we do use a photo, we do not include anything that shows where the home is, such as an address, street name or house number. If you want a photo removed, email us with your request and we will remove it.
8. Cookies and similar technologies
This website does not use advertising or tracking cookies. If we add analytics later, we will update this policy first. Videos are shown through YouTube’s privacy-enhanced mode, which loads only when you press play, but the preview images for those videos are requested from YouTube when the page loads. When customer accounts are added, we will use essential cookies or local storage only to keep you signed in.
9. Keeping your information safe
We use reasonable safeguards for the sensitivity of the information: encrypted connections, private file storage, access limited to the people who need the information, and secure accounts for the services we use. No method of storing or sending information is completely secure, so we cannot guarantee absolute security. If a breach creates a real risk of significant harm to you, we will tell you and the Privacy Commissioner of Canada as the law requires.
10. Your rights
You can ask us at any time to:
- tell you what personal information we hold about you and how we use it;
- correct information that is wrong or out of date;
- stop contacting you, or withdraw a consent you gave us;
- delete your personal information (see section 6).
We will confirm your identity before sharing or deleting information. We aim to reply within 30 days. If we need more time, we will tell you why and reply within 60 days at the latest. If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca.
11. Children
This website is for adults who own or manage a home. It is not directed at children, and we do not knowingly collect information from anyone under 16.
12. Changes to this policy
We may update this policy as our business or the law changes. The date at the top shows when it was last updated. If a change is significant, we will tell you in a clear way before it applies to information you have already given us.
